The Logs in the Sky name, the logsinthesky.com domain, and all related names, logos, product and service names, designs, and slogans are trademarks of Logs in the Sky or its affiliates or licensors. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or internal business purposes. This license does not include any right to resell or commercial use of the Service or its contents, any derivative use of the Service or its contents, or any use of data mining, robots, or similar data gathering and extraction tools.

6. User Content

The Service may allow you to upload, submit, store, send, or receive content, including log data, configurations, and other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through the Service.

By making any User Content available through the Service, you grant to Logs in the Sky a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that User Content solely in connection with providing and improving the Service. This license continues even after you stop using the Service for User Content that you have shared with other users.

You represent and warrant that you own or have the necessary rights to all User Content you submit and that such User Content does not violate any third-party rights or applicable laws. You agree that you will not submit User Content that is copyrighted, protected by trade secret, or otherwise subject to third-party proprietary rights unless you are the owner of such rights or have permission from the rightful owner.

We reserve the right to remove or refuse to display any User Content that we believe violates these Terms or is otherwise objectionable. However, we are not responsible for monitoring or screening User Content and assume no liability for User Content.

THE LOGS IN THE SKY SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, LOGS IN THE SKY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Logs in the Sky does not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of its correctness, accuracy, reliability, or otherwise.

You acknowledge that your use of the logsinthesky.com Service is at your sole risk. We do not guarantee that the Service will meet your requirements or that any data stored through the Service will be secure or not lost or corrupted. You are responsible for implementing sufficient procedures and checkpoints to satisfy your requirements for data backup and security.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOGS IN THE SKY, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO LOGS IN THE SKY IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to defend, indemnify, and hold harmless Logs in the Sky, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of these Terms of Service
Your use of the Service, including but not limited to your User Content
Your violation of any rights of another person or entity
Your violation of any applicable laws, rules, or regulations

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us at the email address provided in the Contact Information section below. Upon termination of your account, we may delete your User Content and any other data associated with your account, subject to our data retention policies and applicable law.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco County, California, and you hereby irrevocably consent to the personal jurisdiction and venue therein.

You agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

12. Changes to Terms

Logs in the Sky reserves the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will notify you by posting a notice on the logsinthesky.com website or by sending you an email to the address associated with your account. Material changes will take effect thirty (30) days after such notice is provided, except that changes addressing new functions or made for legal reasons will be effective immediately.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

13. Miscellaneous

These Terms constitute the entire agreement between you and Logs in the Sky regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
